These Terms & Conditions ("Terms") apply to your use of the website and services of CARGO EXP INC ("CARGO EXP INC", "we", "us" or "our"), including our SMS text messaging program. By using our website or opting in to receive text messages, you agree to these Terms.

1. SMS Messaging Program

a. Program description. By opting in, you may receive the type(s) of messages you selected:

• Customer care messages: quote follow-ups, pickup and delivery updates, dispatch details, appointment reminders, and replies to your questions.
• Marketing messages (only if you separately opted in): service announcements, offers and company news.

b. How to opt in. You opt in by checking the SMS consent box(es) on our website quote form and providing your mobile number, or by giving us verbal or written consent. Consent is not a condition of any purchase or service.

c. How to opt out. You can cancel the SMS service at any time. Just text STOP to the number that messaged you. After you send STOP, we will reply with one message confirming that you have been unsubscribed, and you will no longer receive SMS messages from us. To join again, sign up as you did the first time or text START, and we will start sending messages to you again.

d. Help. If you have trouble with the messaging program, reply HELP for more assistance, or reach us directly at (773) 663-1870 or [email protected].

e. Rates and frequency. Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have questions about your text or data plan, contact your wireless provider.

f. Carrier liability. Wireless carriers are not liable for delayed or undelivered messages.

g. Eligibility. You must be at least 18 years old and the account holder or authorized user of the mobile number you provide.

h. Privacy. Your mobile number and SMS consent will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

2. Use of Our Website

You agree to use our website only for lawful purposes and to provide accurate information in any form you submit. You may not attempt to disrupt, damage or gain unauthorized access to the website or its systems.

3. Quotes and Services

Quotes provided through the website, by phone or by text are estimates based on the information you give us and are subject to change if shipment details, availability, fuel costs or other conditions change. All freight transportation is governed by the rate confirmation, bill of lading, and any written agreement between you and CARGO EXP INC.

4. Employment Inquiries

Submitting an inquiry about a driver or owner-operator position does not create an offer of employment or a contract. All positions are subject to our hiring process and applicable DOT/FMCSA requirements.

5. Intellectual Property

All content on this website, including text, graphics and logos, belongs to CARGO EXP INC or its licensors and may not be copied or reused without our written permission.

6. Disclaimer and Limitation of Liability

The website is provided "as is" without warranties of any kind. To the fullest extent allowed by law, CARGO EXP INC is not liable for any indirect, incidental or consequential damages arising from your use of the website or the SMS program. Liability for cargo is governed by the applicable shipping documents and law.

7. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date shows the latest version. Continued use of our website or SMS program after changes means you accept the updated Terms.

8. Governing Law

These Terms are governed by the laws of the State of IL, without regard to conflict of law rules.
